NEW Department of Labor Poster (Families First Coronavirus Response Act)

The Department of Labor has released posters that need to be posted in your establishment. Each covered employer must post a notice of the Families First Coronavirus Response Act (FFCRA) requirements in a conspicuous place on its premises. An employer may satisfy this requirement by emailing or direct mailing this notice to employees or posting this notice on an employee information internal or external website.  This notice does not apply to recently laid-off individuals and you are not required to share this with them. All employers covered by the paid sick leave and expanded family and medical leave provisions of the FFCRA (i.e., certain public sector employers and private sector employers with fewer than 500 employees) are required to post this notice.

HR 2601 – FMLA Statute Temporary Amendments

Since the emergency FMLA expansion is made apart of the existing FMLA statute via a temporary amendment, and because the legislation does not explicitly address the issue of counting employees. Employers should assume the existing FMLA rules on counting employees remain in place until the DOL issues new guidance/regulations.  Right now, the rules are clear that full-time employees, part-time employees, employees on leave, seasonal employees paid compensation during the week of assessing coverage or, if not paid, who are on payroll and/or the employer reasonable expects to return to active employment,  are all counted for purposes of determining employer coverage.

Missouri leaders protect food supply, agriculture businesses
On March 24, Governor Mike Parson in coordination with the Missouri Departments of Health and Senior Services and Agriculture, approved a request from Dr. Randall Williams to create a consistent directive across local governments for any individual or business that is part of the food supply chain. Farmers, ranchers, agriculture businesses and grocery stores are encouraged to continue essential business functions to feed, fuel and clothe our citizens.

Canadian Prime Minister and Government Announcements 

On March 27, 2020, the Government of Canada is revising its support for Canadian businesses that are affected by COVID-19, their employees, and their families. The new measures announced include that the government will cover up to 75% of the wages for small and medium-sized businesses backdated till March 15, 2020. Additionally, interest-free loans up to $40,000 will be available, with as much as $10,000 of those loans being forgivable, as long as certain conditions are met. More details on the program will be provided shortly, but in the meantime, these and previous measures are outlined at the Government of Canada website. Support For Businesses

May 18, 2020 – Finance Minister Bill Morneau announced the extension and the expanded eligibility of the Canada Emergency Wage Subsidy (CEWS) program.
