Right to Repair Bill Introduced in Wisconsin

Earlier this month, we noted that a Right to Repair bill specific to agriculture was expected to be introduced in the Wisconsin legislature. Assembly Bill 147 was introduced this week and referred to the Committee on State Affairs. The bill was co-sponsored by 31 legislators (30-D, 1-R).

NAEDA has analyzed the bill language that follows the typical Right to Repair legislation we have seen introduced around the country. The bill contains language that would require the OEM to sell parts, tools, documentation, and diagnostics on “fair and reasonable terms.” As they say, the devil is in the details and the definition of that term is very problematic for OEMs and dealers. This legislation effectively turns your supplier into your competitor for the sale of parts.

The bill also contains nonsensical language requiring software be provided for free and cannot not require an internet connection to upload. We have seen this provision elsewhere and it remains to be explained how it makes sense. Another provision would create a private cause of action giving any owner or independent repair shop the ability to file a lawsuit for violations of the act.

This is a terrible bill in concept and design that we will be fighting hard against. We have submitted our position statement to the committee chair and requested a meeting.
