The New Mexico legislative session kicked off last week with a flurry of bill filings. Among them was Right to Repair legislation introduced as Senate Bill 69 sponsored by Senators Pope and Stefanics. After introduction, the bill was referred to the Senate Tax, Business, and Transportation Committee.
The good news is the bill is aimed at household consumer electronics and contains our industry exemption. Section 5(G)(4) of the bill provides that the act does not apply to equipment manufacturers or dealers. The industry exemption language is comprehensive and includes all products our dealer members sell.
We are appreciative of the bill sponsor’s willingness to work with NAEDA and other industry stakeholders to include our industry exemption. Right to Repair bills relating to household consumer electronics that contain our industry exemption has become the trend across the country, and we have worked hard to ensure New Mexico was part of that trend as well.
We will continue monitoring this legislation during session to make sure our exemption remains intact. If you have any questions relating to this bill or others, please contact me directly.
