Texas has passed a Right to Repair law, which takes effect on September 1, 2025. The law exempts agricultural equipment manufacturers who have industry-recognized MOUs concerning repair, which currently include AGCO, Case IH, CLAAS, John Deere, Kubota, and New Holland. Additionally, it provides full exemption for construction equipment, home appliances, powersports vehicles or outboard motors, aerospace, airplane, and train equipment.
Despite NAEDA’s best efforts to have the sponsor of this legislation broaden the ag exemption language to ensure that all our members’ products are exempt, there is now the possibility that products from manufacturers not listed above will be required to comply with the law’s mandates. This includes providing parts at cost to third parties.
This law does not place any mandates on dealers. It is only applicable to Original Equipment Manufacturers (OEMs), but it does have the potential to alter dealers’ relationships and business dealings with both their suppliers and customers.
NAEDA is gathering information from our Texas dealers to help the Association understand which lines our members carry that may be affected. The Association will use this information to help prioritize outreach to OEMs that represent the most significant exposure for our members. NAEDA will seek to understand the manufacturer’s intended response to this law and help our members navigate any changes that may be coming.
