Late yesterday afternoon, February 25, 2025, the West Virginia Committee on Government Administration announced they would hold a hearing today – February 26, 2025 – at 2:00 pm to hear HB 2373 “Equipment Right to Repair Act.”
NAEDA opposes this bill and has submitted written testimony stating our position, which is attached for your reference.
This bill is different from bills we’ve seen in the past. It would require that OEMs make parts, tools, and documentation available for consumers and third-party repair providers after the expiration of the equipment’s warranty. As mentioned in our position statement in opposition to the bill, this is unnecessary and redundant, given that OEMs and dealers already provide this despite warranty status.
Additionally, this bill would still require that “embedded software” be provided to consumers and third-party repair providers after the expiration of the original warranty period. This creates several safety and emissions controls concerns and conflicts with federal law.
