In follow up to our November 1, 2024 alert regarding Bills C-244 and C-294 being passed and added to the Copyright Act, we want to advise dealers that provincial regulators are beginning to make inquiries about the impact of the new regulations on equipment dealers.
Specifically, the Alberta Farmer’s Advocate Office contacted NAEDA seeking information about the availability of repair and diagnostic tools for customers (producers) and third-party technicians to repair their equipment. From their communication, it is clear we need to educate them about the sales process as well as how the tools work.
Initially the questions appeared to be a simple lack of operational knowledge – what happens between a dealer and a customer (producer or third-party repair shop). But their direction seemed a bit odd, like they were seeking a specific answer.
Perhaps the FAO or their clients were expecting different outcomes from the legislation and believed the changes would create significant change in dealer operations. But neither C-244 nor C-294 changed how dealers currently operate. Repair tools have always been available and will continue to be so, and interoperability remains in the best interest of the equipment owners and dealers.
In response to the FAO’s request, we provided the “Farmer Fix It“ link on our website to present the wide array of repair resources available from major line manufacturers for customers and independent repair shops. However, it will be important to follow up continually to ensure our message is not diluted by right to repair advocates.
