Governor Abbott signed HB 2963 on June 20, 2025, making it the first Right to Repair bill passed by a Republican-controlled state. It is set to take effect on September 1st of this year.
NAEDA opposed this bill alongside our coalition partners, seeking the inclusion of our industry exemption language. While we were unsuccessful in securing that exemption, the final bill does contain several important provisions.
Key Exemptions and Limitations:
- Farm equipment manufacturers that comply with an MOU
- Heavy equipment and powersport vehicles
- Scope limited to consumers purchasing products “primarily for personal, family, or household purposes” (a significant amendment NAEDA advocated for when our industry exemption was rejected)
- Private cause of action prohibited; enforcement limited to the Texas Attorney General
Despite the primary sponsor’s initial commitment to accept our industry exemption language and NAEDA’s extensive engagement throughout the session, he ultimately passed the bill without it at the last minute.
While disappointed with this outcome, NAEDA’s advocacy efforts successfully improved the bill’s final form and limited its scope compared to the original proposal.
