Right to Repair Amendment to Defense Authorization Act

On July 15, 2025 the House Armed Services Committee will be meeting to markup the FY25 Defense Authorization Act. Senators Tim Sheehy (R-MT) and Elizabeth Warren (D-MA) have authored a Right to Repair provision to incorporate in the must pass legislation that they are dubbing the Warrior Right to Repair Act.

The legislation is short but contains a provision that requires dealers to sell at the same cost and on the same terms as they receive from the supplier for all DoD contracts. This same provision was introduced last year and defeated, but this year the bill is sponsored by a Republican Senator. NAEDA is contacting committee members and the bill sponsors to oppose this language and defeat it once again. We are also working with a broad coalition led by the National Manufacturers Association to   oppose adoption of any Right to Repair provisions.

Call to Action: The House Armed Services Committee needs to hear from dealers how dangerous including a provision like this would be and would set the precedent for further bills that would destroy our business model. If you have a dealership or relationship with any member of the committee, please contact them and ask them to oppose this provision that would prohibit dealers from making any profit, which will only reduce the ability for the military to quickly repair their equipment. If you do not have a location within a member’s district, please contact Chairman Mike Rogers office at: (202) 225-3261.

If you have questions or comments, please contact Eric Wareham or Kipp McGuire directly.
