Massachusetts Legislature Hearing Right to Repair Bills

The Joint Committee on Consumer Protection and Professional Licensure will be hearing several bills on Right to Repair tomorrow, 1 Oct 2025.

Notably, H.452 is an agricultural equipment-specific bill proposing Right to Repair mandates on Original Equipment Manufacturers and Authorized dealerships in Massachusetts.

WHY IT MATTERS:

This bill includes mandates that are problematic for equipment dealers and their business models, which include:

  • Fixing the price of parts at the same cost OEMs give to their best dealers.
  • Require that OEMs provide parts directly to customers at the best cost they give dealers. Making equipment dealers’ suppliers into their competitors.

The Memorandums of Understanding (MOUs) between major manufacturers and the American Farm Bureau Federation (AFBF) have been in effect since 2023.

  • These agreements are a private sector solution that allows for flexibility and updating that legislation is incapable of providing.
  • Parties to these agreements have reviewed them every six months since their founding and have deemed that they are working.
  • As of April 2025, only two complaints by consumers had been made to the AFBF.
    • One was deemed non-viable
    • One was deemed a viable complaint, and a solution was brokered per the MOU between AFBF and the manufacturer to the customer’s satisfaction.

TAKE ACTION:

NAEDA has submitted written testimony in opposition to this legislation. The association encourages Massachusetts dealers to do the same.
