West Virginia Legislature Continues Hearings on Right To Repair

The West Virginia Legislature has continued a flurry of hearings on Right to Repair legislation. NAEDA previously sent a legislative alert concerning H.B. 2373, which was heard by the House Committee on Government Organization on February 26th. That bill has had an additional hearing held by the same committee on March 4th since then. The status of that bill is pending in committee as of this writing. During the February 26th hearing, the WV Commissioner of Agriculture’s Chief Counsel provided remarks that they believed the state needed to use this as an investment opportunity in vocational training and expand training for equipment technicians.

The Senate has now scheduled a hearing for another Ag-specific bill, S.B. 242, which is similar to the one introduced last year. NAEDA assesses this bill as detrimental to dealers because of its price-fixing mandates and requirements for manufacturers to provide access to embedded software. NAEDA has provided the attached Position Statement as written testimony to the Senate Agriculture Committee.

NAEDA will continue to work on these bills and provide members with updates as the legislative session continues. If you have any questions or would like to discuss any of these bills, please reach out to NAEDA’s Director of Government Affairs, Kipp McGuire, via email – kmcguire@naeda.com – or phone (771) 208-4009.
