For the past several years, a farm equipment lemon law has been introduced in the Wisconsin legislature. This year, Senate Bill 8 was introduced by Senator Andre Jacque (R) and Senator Cory Tomczyk (R). The bill was referred to the Committee on Transportation and Local Government back in January and has sat there since. The bill is now scheduled for a committee hearing on May 6th at 1:00 pm.
NAEDA has submitted a position statement to the committee members opposing the bill and asking for amendments. A handful of farm machinery lemon laws have been enacted in recent years across the country. Our priority in these bills is to ensure the legislative mandates and enforcement mechanisms are placed on the manufacturer, not the dealer. That includes protecting the dealer from chargebacks and being adequately compensated for warranty work performed by dealers on machinery that is nonconforming under the proposed act.
