A Right to Repair bill has been introduced in the Pennsylvania House of Representatives. Representative Kyle Mullins, a Democrat representing District 112, is the primary sponsor and was joined by 28 co-sponsors (26 Democrats and 2 Republicans).
House Bill 2535 was introduced on August 15th and referred to the House Commerce Committee the same day. As of this writing, it has not been scheduled for a hearing.
PA HB 2535 has language that NAEDA finds problematic, such as requiring parts be sold at net cost by manufacturers. However, it also contains exemption language for “off-road equipment, including farm and utility tractors, farm implements and farm machinery; (ii) forestry equipment; (iii) industrial equipment; (iv) utility equipment; (v) construction equipment; (vi) road-building equipment; (vii) compact construction equipment; (viii) mining equipment; (ix) turf, yard and garden equipment; (x) outdoor power equipment.” This is comparable to language that NAEDA has advocated for inclusion in other states’ Right to Repair legislation.
NAEDA assesses that this bill is unlikely to threaten dealers’ businesses. We will continue to monitor the situation and offer updates as it develops over the remainder of the session, which ends on 30 November 2024.
